The H-2B Visa allows US employers to hire foreign nationals to work on a temporary basis in the US for non-agricultural employment positions. The H-2B visa is available to an alien who is coming temporarily to the US to perform temporary services or labor, is not displacing US workers capable of performing such services or labor, and whose employment is not adversely affecting the wages and working conditions of US workers.
To qualify, an employer's need in hiring workers must be justified under one of the following regulatory standards: One-Time Occurrence, Intermittent, Seasonal or Peakload hiring need. The employer is required to provide H-2B workers a minimum of 35 hours per week and employment compensation must meet the prevailing wage set by the local state workforce agency.
